Users and members accessing the website and mobile application via the URL address acknowledge and accept the terms and conditions regarding the use of the service by logging into the website and mobile application. In this agreement, GDH Media and Technology Services Inc. will be referred to as "GDH" in the provisions below.

First and foremost, you are required to read and approve these terms of use. If you do not accept the provisions and conditions stated in the user agreement, you must cease your access to the website and mobile application.

Subject

This agreement contains the rights and obligations of users accessing the "Clash Report" news site, as well as the terms and conditions regarding the use of the site.

GDH Rights and Responsibilities:

1. https://clashreport.com/The rights to the name, all content, templates, design, videos, music, and all records and documents on the site, including but not limited to the information, visual and written records contained therein, as well as all rights recognized under the Law on Intellectual and Artistic Works No. 5846 ("FSEK") related to the works on the site, belong to "GDH."
2. No video, music, visual, document, page, graphic, design, or any other element or content on the Clash Report news site may be published, used, copied, transferred, or quoted in any medium, whether in whole or in part. The performances and/or works within the Gündeme Dair Her Şey news site, whose rights are reserved, may not be reproduced, distributed, quoted, published, performed, communicated to the public, or used in any way without the consent of the rights holders.
3. GDH, its managers, employees, or representatives, affiliates, shall not be liable for any damages, including but not limited to loss of use, profit, or data, whether direct, special, indirect, or consequential, arising from or in connection with the use of the site, services, GDH content, or materials accessed through the site, whether caused by natural disasters, communication disruptions, theft, destruction, unauthorized access to GDH records, programs, or services, reliance on information obtained from GDH, errors, omissions, interruptions, deletion of files or emails, or delays in operation or transmission.
4. All legal, administrative, and criminal liability arising from the use of the Clash Report news site, the management of its content, and the transactions carried out through the site belong to the User. GDH shall not be held liable, directly or indirectly, for any damages that third parties may suffer due to actions of the Users in violation of these Terms and the law. Any claims from third parties in this context, as well as any damages GDH may incur due to the User's failure to fulfill their obligations under these terms or applicable legislation, shall be recouped from the User along with all ancillary costs upon first demand.
5. Clash Report news site makes all reasonable efforts to ensure the accuracy, appropriateness, and reliability of its content but does not guarantee its accuracy, appropriateness, or reliability.
6. Clash Report news site may contain links to other websites operated by third parties for convenience in accessing such sites. GDH does not operate or control the information, products, or services provided on the linked sites or applications. It does not provide any explicit or implicit warranty regarding the content and use of such sites. GDH does not guarantee the accuracy or security of the content on these sites. The User is solely responsible for the use of the sites and applications accessed through links.
7. When necessary, relevant/authorized public institutions and organizations, judicial or administrative authorities, and law enforcement agencies may request information regarding Users. In such cases, GDH shall have the right to disclose the requested information about the User immediately, as required by the Turkish Penal Code or Law No. 5651, without requiring the User's consent.

User Rights and Responsibilities:

1. The term "User" refers to any natural or legal person who uses the site in any way, whether by logging in as a member or without logging in. By accepting this Agreement and voluntarily uploading content to the Site, users grant Clash Report news site the right to publish said content on the Site. By using Gündeme Dair Her Şey news site, the User acknowledges that they have read, fully understood, and agreed to all provisions of this User Agreement.
2. By accessing Clash Report news site, the User agrees to comply with the terms and applicable regulations. If the User does not accept these terms, they may not use or access the site. By accepting this Agreement, individual users confirm that they are over 18 years old and have the legal capacity to enter into a contract. Additionally, by accepting the Agreement, users irrevocably declare and undertake that they are authorized to log into Clash Report news site and assume full responsibility for using the services and accessing the Site.
3. Users are solely responsible for any legal, criminal, administrative, and financial liabilities that may arise due to violating the terms of use and applicable laws.
4. Users agree to provide accurate, truthful, and complete information when requested by the Company regarding the use of our website. If the Terms of Use are amended, they commit to complying with the necessary changes.
5. Users acknowledge and undertake that they may not use, commercialize, transfer to third parties, store, or archive any materials or data obtained from Clash Report news site beyond individual purposes. 6. While using the Internet Site, users agree to comply with the provisions of the Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Industrial Property Law, Turkish Code of Obligations, and related regulations, as well as any notices and announcements published by GDH on the Internet Site.
7. Users must fully comply with the Personal Data Protection Policy and Cookie Policy published on the Clash Report news site. These policies are accessible from the site.
8. Users may not copy, use, or unlawfully access the software used in the design and database creation of Clash Report news site, nor may they attempt to hack the site.
9. Users may not engage in activities that prevent or hinder the use of Clash Report news site, overload or lock servers and databases with automated programs, or attempt fraudulent activities.
10. Users may not use software or programs that threaten security or disrupt the functionality of the site’s software.
11. Users acknowledge and undertake that all photographs, digital works, images, and other materials uploaded to the Site (hereinafter collectively referred to as "Content") do not infringe on the intellectual and industrial property rights of third parties. The Content must not violate the Turkish Penal Code, the Law on Regulation of Publications on the Internet, or other applicable legislation, nor contain elements that may constitute a crime. If any content violates these laws or infringes on third-party rights and is detected by GDH, GDH reserves the right to remove the Content from the Site without prior notice and restrict the User’s access to the Site. In such cases, GDH shall bear no responsibility towards the User.
12. The following types of content, actions, and behaviors are prohibited on the Site:
    1. (a-) Violations of Law No. 5816 on Crimes Committed Against Atatürk:No content that defames or insults the fundamental values of the Republic of Turkey or our great leader Atatürk, in violation of Law No. 5816 on Crimes Committed Against Atatürk, is permitted.
    2. (b-) Fraud:No content that defames or insults the fundamental values of the Republic of Turkey or our great leader Atatürk, in violation of Law No. 5816 on Crimes Committed Against Atatürk, is permitted.
    3. (c-) Insult and Harassment:Freedom of expression is supported on the site. However, while providing users with a platform to express themselves freely, harassment, defamation, insult, or attacks on the personal rights of others are not permitted. Additionally, content and aggressive behavior that insult or degrade individuals or groups based on their religion, language, gender, race, ethnicity, or nationality, as well as acts such as threats, harassment, invasion of privacy, and attacks on personal rights, are strictly prohibited.
    4. (d-) Obscenity and Pornography:No form of pornography is permitted. Photos, images, or texts depicting sexual acts, especially those involving child/adolescent nudity, child pornography, any form of child sexual exploitation, or content that encourages or resembles such acts, are strictly prohibited. Additionally, content considered obscene under the Turkish Penal Code is not allowed.
    5. (e-) Drugs and Narcotics:Content promoting, marketing, recommending, facilitating the use of, or providing substances classified as narcotics or stimulants, including prescription drugs and substances that cause addiction, is strictly prohibited.
    6. (f-) Violence and Suicide Encouragement:Content that encourages or promotes suicide, or that contains violent material, is strictly prohibited. Therefore, any content involving harm to humans or animals, killing, mutilation, brutality, or any other content that poses significant psychological risks to people or encourages suicide is not allowed.
    7. (g-) Weapons and Explosives:Content related to the illegal manufacture, marketing, or use of weapons or explosives is strictly prohibited on the Gündeme Dair Her Şey news website.
    8. (h-) Gambling, Contests, and Betting:Any content related to gambling or providing a place and opportunity for gambling is prohibited. Additionally, any content used for commercial activities such as contests, betting, bartering, advertising, or pyramid schemes without prior written permission is not allowed.
    9. (i-) Intellectual and Industrial Property Rights:The Clash Report news site requires respect for the intellectual and industrial property rights of others. Users may only upload content (such as photographs, digital works, images, writings, etc.) for which they own the intellectual and industrial property rights (as the creator or as a legal license holder with the right to use, publish, and transmit the works). If a user copies, uses, publishes, distributes, or transmits content such as photographs, images, or writings belonging to another person (including other members) without the permission of the rights holders, GDH Technology has the right to remove such content upon complaint or on its own initiative. Additionally, it reserves the right to terminate the membership of users violating these rights and to deny them access to the site. Members and users who violate the intellectual and industrial property rights of third parties are personally responsible for such violations and any resulting damages.
    10. (j-) Hacking:All content that praises criminal acts, encourages crime, causes unfair competition, promotes/distributes illegal computer software, or distributes any type of computer virus will be deleted without any prior warning or permission.

Other Provisions:

1. If one or more provisions of the terms of use are deemed invalid for any reason, the remaining provisions of the Terms shall not be rendered invalid.
2. GDH may make changes in the implementation of these Terms, modify or cancel existing provisions, or add new provisions without being required to notify Users in advance, due to future technical necessities and compliance with regulations. The User shall be deemed to have accepted the updated terms of the agreement as soon as they access the site. The services provided by the Clash Report news site shall not constitute acquired rights for the Users.
3. The provisions of the Terms of Use Agreement shall remain in effect as long as the User accesses the website.
4. Any disputes arising from the interpretation and enforcement of this User Agreement that cannot be resolved through mutual negotiations shall be subject to the jurisdiction of the T.C. Bakırköy Courts and Enforcement Offices.
